FMM SHE Conference 2022 - Challenges of Endemic to Occupational Safety & Health
The Occupational Safety and Health (Amendment) Act2022 which was gazetted on 16 March 2022, features significant amendments to the existing Occupational Safety and Health Act (OSHA) 1994. With the introduction of 27 new sections, the removal of 2 sections, the amendment of 35existing sections, the repeal of the Factories and Machinery Act (FMA) 1967 and the integration of FMA provisions and OSHA into one comprehensive safety and health legislation, the major amendments in Occupational Safety and Health (Amendment)Act 2022 provide workers with better quality of safe and healthy environment.
The key amendments under the Occupational Safety and Health (Amendment) Act 2022 are, among others, amendments apply to all places of work; duty on principal to ensure the safety of contractors and sub-contractors; duty to conduct risk assessment; duty to develop and implement procedures to deal with emergencies; appointment of occupational safety and health coordinator; employees’ right to ‘remove’ themselves from ‘imminent danger’ at the workplace; increased penalties and punishments for recalcitrant employers, self-employed persons, principals, and manufacturers; directors and office bearers jointly and severally liable; and many more.
