Dialogue Session on Strategic Trade Act 2010 (GPR/02/2011)

Further to the FMM circular (GPR/08/2010) dated July 28, 2010 on the implementation of the Strategic Trade Act 2010 (STA 2010), the Ministry of International Trade and Industry has recently announced the Act was gazetted on December 31, 2010. The Act also provides exemption for permits for the list of items as attached (exemption for permits)

For members’ information, Malaysian companies dealing with any of the listed strategic items or technologies would be required to obtain a permit for the exports of their goods and technology under the STA 2010. This Act provides control over export, transshipment, transit and brokering of strategic items including arms and related materials, and other activities that will or may facilitate the design, development and production of mass destruction and their delivery systems. The Act will be enforced on July 1, 2011.

Apart from the 1,569 strategic items which require export permits effective July 1, 2011, companies that are aware that their products can be used as Weapons of Mass Destruction (WMD) are also required to register their products with MITI. If the product is not registered and subsequently found to be used as a WMD, the company may be held liable and will be penalized accordingly. The list of 1,569 products can be viewed on MITI’s website at www.miti.gov.my.

In view of the impact of the Act on companies, a Dialogue will be held with the Strategic Trade Controller, Encik Mohamed Shahabar Abdul Kareem on March 21, 2011 (Monday), 2.00pm at Dewan FMM, Wisma FMM, Kuala Lumpur for members. The briefing is also aimed at providing an avenue for members to seek further clarification and to highlight their concerns on the implementation of the Act. FMM would like to urge affected members to attend this important Dialogue.

Details of the programme are attached for your information. Participation is FREE OF CHARGE and will be on first come first served basis as only 100 seats are available. Each company is only allowed to send one representative to the dialogue session. Interested members are requested to submit the completed registration form to the FMM Secretariat before March 14, 2011.
