Declaration of Public Holiday in Terengganu

The Terengganu State Government has declared September 11, 2022 as a Public Holiday in Terengganu in conjunction with “PerlawananAkhir Piala FA 2022”. The said public holiday is not declared under Section 8 of the Holidays Act 1951 and therefore members are not legally obliged to observe September 11, 2022 as a paid holiday as required under section 60D(1)(b) of the Employment Act 1955.

However, if under the terms and condition of service provided under contract of service or collective agreement, in which the employer is required to observe all Government Gazetted holiday then employer is required to observe the above holiday as a paid holiday with the following application:

A. For Employees Covered under the Employment Act, 1955

Members in Terengganu must observe September 11, 2022 as a paid public holiday.

However, members that need to run their operations on September 11, 2022, members have the following options:

1) In the event that the employee is required to work, the employee shall be paid two days wages at the
    Ordinary Rate of Pay (ORP) in addition to the holiday pay;

2) With the agreement of the employees, substitute it with any other day as a paid public holiday not later
    than December 31, 2022 and later if the employee is required to work on the substituted holiday, the
    employee shall be paid two days wages at the ORP in addition to the substituted holiday pay;

B. For Employees NOT Covered under the Employment Act 1955

The company has to observe September 11, 2022 as a paid public holiday. 

If an employee is requested to work, an employer may grant a substituted public holiday or   benefits / payments as agreed under the terms and condition of service provided under contract of service or collective agreement for working on a public holiday.
